Terms of Service

Giftsama is a gift planning web app built to help users organize gift buying across occasions, recipients, gift ideas, budgets, and gift statuses.

For these Terms, "Giftsama," "we," "us," and "our" mean [Insert Legal Company Name], the company that owns and operates Giftsama. "You" and "your" mean the person who creates an account, visits the website, or uses the service.

Giftsama is an organization and tracking tool for gift planning. You can use it to:

• Create occasions — birthdays, holidays, graduations, baby showers, teacher appreciation gifts, and other gift-related events
• Add recipients under each occasion
• Save gift ideas for each recipient, including names, links, estimated prices, actual prices, images, and notes
• Track gift status from idea to bought, wrapped, and given
• Set budgets for occasions and individual recipients
• View spending and planned gift costs at a glance
• Save profile preferences related to your gift planning style
• Receive reminders when reminder features are available

Giftsama is not a gift recommendation engine, shopping service, wishlist tool, calendar app, social platform, or payment processor. You are responsible for buying gifts from third-party stores outside Giftsama.

You must be at least 18 years old, or the age of legal majority where you live, to create an account and use Giftsama. By using Giftsama, you confirm that you are legally allowed to agree to these Terms, that the information you provide is accurate, and that you will use Giftsama only for lawful purposes.

If you are using Giftsama on behalf of another person, household, business, or group, you confirm that you have permission to do so.

To use Giftsama, you will need to create an account. When you do, you agree to provide accurate and current information and to keep your login details safe. You are responsible for all activity that happens under your account, unless that activity resulted from our own security failure.

Please contact us right away if you believe someone has accessed your account without permission. We may suspend or close accounts that contain false information, break these Terms, abuse the service, or create risk for Giftsama or other users.

When you use Giftsama, you may add occasion names, recipient names, relationship types, gift ideas, product URLs, prices, notes, images, budgets, and other planning details. This information is called "User Content."

You keep ownership of the User Content you add to Giftsama. We do not own your gift lists, notes, or planning data. However, by adding User Content, you give us permission to store, process, display, back up, and use that content only as needed to provide and improve the service.

Please do not add anything that is unlawful, harmful, abusive, or that violates someone else's rights or privacy.

Giftsama is designed for gift planning — not for storing highly sensitive personal information. Please do not store government identification numbers, financial account numbers, passwords, medical records, or private legal records in Giftsama.

You may add personal gift notes such as clothing sizes, allergies, favorite stores, or gift preferences. You are responsible for making sure you have the right to store that information.

Free Plan

The Free plan lets you try Giftsama and includes:

• 1 occasion
• 5 recipients
• 3 gift ideas per recipient

We may change Free plan limits in the future and will provide reasonable notice of major changes.

Pro Plan

The Pro plan is a paid annual plan that includes unlimited occasions, unlimited recipients, unlimited gift ideas, and access to all paid features.

If you buy a paid plan, you agree to pay the price shown at checkout plus any applicable taxes. Payments are processed by a third-party payment provider. We are not responsible for payment errors caused by that provider.

By entering payment information, you confirm you are authorized to use the payment method, that your billing information is accurate, and that you authorize the charge. If your payment fails, we may limit, suspend, or end access to paid features until payment is completed.

Your Pro plan may renew automatically at the end of each billing period — once per year for an annual plan — unless you cancel before the renewal date. Subscription terms including price and billing period are presented during checkout. Please review them before purchasing.

Where required by law, we will provide renewal notices, price-change notices, and cancellation details. You are responsible for managing your subscription before renewal if you no longer want the paid plan.

You may cancel your paid plan through the billing portal in your account, or by contacting us at support@giftsama.com.

If you cancel, you may continue to access paid features until the end of your current billing period. Cancelling does not automatically delete your account — you can do that from the Danger Zone in your profile settings.

If your account is downgraded from Pro to Free, some data, features, or access may become limited because the Free plan has usage limits.

Unless required by law, payments for Giftsama are generally non-refundable. This typically includes unused time on a subscription, forgetting to cancel before renewal, or not using the service after purchase.

That said, we want to be fair. If something went wrong with your purchase or account, contact us at support@giftsama.com and we may review it at our discretion. Nothing in this section limits rights you may have under applicable consumer protection laws.

We may change our prices, plan limits, or features from time to time. If a price change affects an existing paid subscription, we will provide notice where required by law. If you do not agree to a future price change, you may cancel before the new price applies.

We may also add, remove, or change features as Giftsama grows. We will try not to make changes that unfairly reduce the core value of a paid plan during an active billing period.

You agree not to misuse Giftsama. You may not:

• Break any law while using Giftsama
• Try to access another user's account
• Store unlawful, abusive, hateful, or harmful content
• Upload viruses, malware, or harmful code
• Damage, overload, scrape, reverse-engineer, or interfere with Giftsama
• Copy, resell, rent, or exploit Giftsama without our written permission
• Use automated tools to access the service in a way that harms our systems
• Misrepresent your identity
• Use Giftsama to harass, stalk, or harm another person
• Upload content that violates intellectual property rights
• Attempt to bypass plan limits, billing systems, or security controls

We may suspend or close accounts that break these rules.

Giftsama lets you save links to third-party stores and product pages. Those sites are not owned or controlled by Giftsama. We are not responsible for their products, prices, availability, shipping, returns, privacy practices, or customer service.

If you buy a gift from a third-party store, your purchase is between you and that store. Prices, images, and product availability may change outside Giftsama, and we do not guarantee that saved links or prices will always stay accurate.

Giftsama may offer reminder features now or in the future. Reminders are meant to help you stay ahead of important dates, but we cannot promise every reminder will be delivered on time or at all. Delivery may be affected by your settings, timezone, email provider, internet access, or other factors outside our control.

You are still responsible for managing your own deadlines, gift purchases, and important dates.

By creating an account, you agree that we may send you service-related emails — including account verification, password reset, billing, subscription notices, security alerts, and important updates. You may also choose to receive marketing emails and can unsubscribe at any time. Even if you unsubscribe from marketing emails, we may still send important service-related messages.

Your privacy matters. Our Privacy Policy explains how we collect, use, store, and protect personal information. By using Giftsama, you agree to our Privacy Policy.

Giftsama, including the website, app design, branding, logo, software, code, text, layout, and features, belongs to us or our licensors. These Terms do not give you ownership of Giftsama or any part of our service.

You may not copy, modify, sell, rent, distribute, or create competing services from Giftsama's software, design, brand, or content without our written permission.

As long as you follow these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use Giftsama for your own personal gift planning needs. We may revoke it if you break these Terms or use Giftsama in a harmful way.

If you send us ideas, suggestions, or feature requests, you agree that we may use that feedback without compensating you or granting you ownership in any changes we make.

We want Giftsama to be reliable, but we do not promise the service will always be available, uninterrupted, secure, or error-free. There may be downtime caused by maintenance, updates, hosting issues, bugs, third-party services, or other factors outside our control.

We may take steps to protect and back up data, but we do not promise that no data will ever be lost. You should keep your own backup of any gift planning information that is very important to you.

We may suspend or terminate your account if you break these Terms, your payment fails, you misuse the service, your account creates risk for others, or we are required to do so by law. You may stop using Giftsama at any time.

After account deletion, some information may be kept for legal, tax, security, or fraud prevention purposes as allowed by law.

Giftsama is a planning and organization tool. We do not provide financial, legal, tax, parenting, shopping, or professional advice of any kind. You are responsible for your own choices, purchases, deadlines, and spending.

Giftsama is provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties that Giftsama will meet every need, always be available, be error-free, that gift prices or links will always be accurate, or that reminders will always arrive on time.

Some laws do not allow certain warranty exclusions, so some of these disclaimers may not apply to you.

To the fullest extent allowed by law, Giftsama and its owners, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages — including lost data, missed reminders, missed occasions, overspending, third-party store problems, or service downtime.

To the fullest extent allowed by law, our total liability for any claim will be limited to the amount you paid to Giftsama in the 12 months before the claim, or $100 if you did not pay us during that period.

You agree to defend, indemnify, and hold harmless Giftsama, its owners, employees, contractors, and partners from claims, damages, losses, and costs — including legal fees — arising from your use of Giftsama, your User Content, your violation of these Terms, or your violation of someone else's rights.

We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date and may provide notice by email, in-app message, or website notice. Your continued use of Giftsama after updated Terms take effect means you accept the updated Terms.

These Terms are governed by the laws of [Insert State/Country], without regard to conflict of law rules. If consumer protection laws where you live give you rights that cannot be waived, nothing in these Terms limits those rights.

If you have a concern or dispute, please contact us first at support@giftsama.com. We would prefer to solve issues directly and fairly.

If we cannot resolve the issue informally, any dispute will be handled in the courts located in [Insert Location], unless the law requires another location. You and Giftsama agree to bring claims only on an individual basis and not as part of a class action, unless applicable law says otherwise.

We are not responsible for delays or failures caused by events outside our reasonable control — including natural disasters, power outages, internet failures, cyberattacks, government actions, pandemics, or payment provider issues.

You may not assign or transfer your rights under these Terms without our written permission. We may assign or transfer these Terms as part of a merger, acquisition, sale of assets, or change in ownership.

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms remain in effect. The invalid part will be changed only as much as needed to make it valid.

If we do not enforce a part of these Terms right away, that does not mean we give up the right to enforce it later. Any waiver must be in writing to be effective.

These Terms, together with our Privacy Policy and any plan or checkout terms shown to you, make up the entire agreement between you and Giftsama about your use of the service.
